  1. Agreement Generally; Acceptance.
    1. The “Terms of Use” governs use of the donation form materials located as a subdomain of this website and as a subdomain of other websites where you may want to make a donation (the “Donation Subsite”). The Donation Subsite facilitates certain functionality on this and each of the other websites affording the opportunity to make a donation (each, referred to as a Website”). Please note these Terms of Use govern only the Donation Subsite, not this or any other Website generally. The operator of a Website is referred herein as a "Website Operator.” The “Donation Subsite” includes services, technologies, content and any other materials available on the Donation Subsite. By agreeing to these Terms of Use, you are agreeing to the Terms of Use for the Donation Subsite as you may use it on any Website where it is available to assist you in making a donation.
    2. This Terms of Use, pertaining to the Donation Subsite, is a contract between, on the one hand, IMGE LLC (“IMGE,” “we,” “us,” or “our”) and, on the other hand, you.  “You” means you personally.  If you are acting for an entity, “you” means you personally and the entity on whose behalf you are acting.  In the event you are acting for an entity, you represent and warrant that you are authorized to so act for such entity.  You represent that you are over the age of eighteen (18) years old and authorized to enter into binding obligations.
    3. YOUR right to use the DONATION SUBSITE is subject to your accepting the terms of Use and doing so electronically.  If you do not accept the terms of Use, YOU may not use the DONATION SUBSITE.  If you wish to accept the terms, please click “I ACCEPT” after reading the terms. 

    Please note that, by accepting the Terms of Use, you are agreeing that disputes relating to the Terms of Use and/or Donation Subsite shall be subject to arbitration in Alexandria, Virginia, on an individual and non-class basis as set forth in Sections 12 and 13.  Please review Sections 12 and 13 and all of the provisions of the Terms of Use.  NOTWITHSTANDING ANY OTHER AGREEMENTS OR TERMS OF USE BETWEEN YOU AND WEBSITE OPERATOR, THE LIABILITY OF WEBSITE OPERATOR AND ITS AFFILIATES AND SUPPLIERS FOR INJURY ARISING OUT OF THE DONATION SUBSITE SHALL BE LIMITED IN ACCORDANCE WITH SECTION 9(e), TO THE EXTENT THAT SUCH SECTION CREATES LIMITS ON LIABILITY THAT ARE MORE RESTRICTIVE AND LIMITING THAN LIMITS THAT MAY EXIST IN OTHER AGREEMENTS OR TERMS OF USE BETWEEN YOU AND WEBSITE OPERATOR.  PLEASE REVIEW SECTION 9(e) AND ALL THE PROVISIONS OF THESE TERMS OF USE.

  2. Modifications to Terms of Use.  You agree to review the Terms of Use prior to each use of the Donation Subsite.  You agree that we may modify the Terms of Use and that such modification shall become effective immediately upon posting of the modified Terms of Use to the Donation Subsite.  If you do not accept the modifications, then you must cease using the Donation Subsite.  The modified Terms of Use will contain the date of posting at the top of the first page. 
  3. Permission to Use the Donation Subsite;  Limitations on Use of the Donation Subsite.  Subject to your acceptance and while you remain in compliance with the Terms of Use, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Donation Subsite solely and exclusively for your own personal use and not for any other purpose.  This license is solely and exclusively for your benefit and not the benefit of any third party.  All other uses of the Donation Subsite are prohibited. 
  4. Donation Payment.  By creating an account on the Donation Subsite and using a credit card, you represent and warrant that you are authorized to use and incur charges on that credit card.   
  5. Prohibited Activity.  You will not: (a) access or attempt to access the Donation Subsite or any part thereof that you are not authorized to access or through any means that you are not authorized to use; (b) disrupt or interfere with the security of, or otherwise cause harm to the Donation Subsite, systems, resources, accounts, passwords, servers or networks connected to or accessible through the Donation Subsite or any affiliated or linked websites or access or use the Donation Subsite in any manner that could damage, disable, overburden, or impair any server or network used by us in connection with the Donation Subsite; (c) use the Donation Subsite to transmit any information of a sensitive nature, such as health information, social security numbers, credit card numbers (other than your credit card number, or any other information that, if generally exposed, could lead to identity theft, financial fraud, embarrassment, or other harm; (d) use the Donation Subsite in any manner that infringes upon or violates any intellectual property rights or other rights or interest of any party or otherwise constitutes pornography, defamation, harassment, bullying, predatory behavior, false and deceptive advertising, or hate speech; (e) submit any software, programs, or files via the Donation Subsite that are harmful or disruptive of another’s equipment, software, or other property, including any corrupted files, time bombs, Trojan Horses, viruses, and worms; (f) disrupt, interfere with, or inhibit any other user from using and enjoying the Donation Subsite or other websites; (g) violate any applicable laws or regulations related to the access to or use of the Donation Subsite, and/or engage in any activity prohibited by the Terms of Use; (h) compile, use, download, or otherwise copy any materials available on the Donation Subsite (except as expressly permitted by the Terms of Use), or transmit, provide, or otherwise distribute (whether or not for a fee) such materials to any third party; (i) use, or allow anyone else to use, any robot, spider, or other such programmatic or automatic device, including but not limited to automated dial-in or inquiry devices, to obtain information from the Donation Subsite or otherwise monitor or copy any portion of the Donation Subsite; (j) frame, mirror, or use framing techniques on any part of the Donation Subsite without our express prior written consent; (k) make any use of, or allow anyone else to make any use of, data extraction, scraping, mining, or other data gathering tools, or create a database by systematically downloading or storing the Donation Subsite, or any portion thereof, or otherwise scrape, collect, store, or use the Donation Subsite, except pursuant to the limited license granted by the Terms of Use; (l) modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Donation Subsite; or (m) remove any copyright, trademark, or other proprietary rights notice from the Donation Subsite.  These examples of prohibited conduct are illustrative and are not exhaustive.   
  6. TO THE MAXIMUM EXTENT AUTHORIZED BY LAW WE RESERVE THE RIGHT, BUT DISCLAIM ANY OBLIGATION WHATSOEVER, TO MONITOR OUR DONATION SUBSITE AND YOUR COMPLIANCE WITH THIS SECTION AND WITH THE TERMS OF USE AS A WHOLE.

  7. Intellectual Property.  
    1. You acknowledge that we own all right, title and interest, including all intellectual property rights, in and to the Donation Subsite, and you hereby disclaim any interest.  We expressly reserve all rights not explicitly granted. 
    2. Our trademarks may not be used in any manner (including in “meta-tags” or “hidden text”) without our prior written approval.  All content included on the Donation Subsite, such as text, graphics, images, audio clips, video, data, music, software, and other material is owned or licensed property of IMGE or its suppliers or licensors and is protected by copyright or other proprietary rights.  Any unauthorized use of these materials may violate trademark, copyright, patent, or other laws and is prohibited.
  8. Copyright Infringement.  We respect the intellectual property rights of others.  It is our policy to terminate the access privileges of those who repeatedly infringe the copyrights of others.  If any person or entity believes that such party’s work has been posted on the Donation Subsite in a way that constitutes copyright infringement, please contact us at the address below and provide the following information:  (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (b) a description of the copyrighted work that the party claims has been infringed, and identification of the URL or other specific location on the Donation Subsite where the material that the party claims is infringing is located; (c) the party’s address, telephone number, and email address; (d) a statement by the party that such party has a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (e) a statement by the party, made under penalty of perjury, that the above-listed information in the notice is accurate and that the party the copyright owner or authorized to act on the copyright owner’s behalf.

  10. Log-In Credentials.  Your login credentials (i.e., email address and password) for the Donation Subsite may be used only by you and only while the license is in effect.  Under no circumstances will you share your login credentials with any other person or entity.  You are responsible for all use of the Donation Subsite that occurs under your account, and you agree to notify us of any unauthorized access of which you become aware.  Without limiting the force of any other disclaimers herein, YOU ARE responsible for any person using or entering information in the Donation Subsite UNDER YOUR credentials or AUTHORITY and ARE responsible to and for any persons relying on the Donation Subsite.  you are solely responsible for errors and omissions in the entry of any information and for reviewing and, as necessary, correcting such information and for any actions or consequences resulting from the entry of such information.
  11. Representations and Warranties;  Disclaimer.
    1. YOU AGREE AND ACKNOWLEDGE FOR OUR BENEFIT AND THE BENEFIT OF THE WEBSITE OPERATOR THAT USE OF THE DONATION SUBSITE, INCLUDING BUT NOT LIMITED TO ANY AND ALL TECHNOLOGIES AND TOOLS, IS WITHOUT WARRANTY OF ANY KIND AND THAT THE ACCESS TO AND USE OF THE DONATION SUBSITE, AS PROVIDED UNDER THE TERMS OF USE, IS PROVIDED “AS IS AND WHERE IS.”  ALL WARRANTIES ARE HEREBY DISCLAIMED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND WARRANTIES BASED ON CUSTOM AND PRACTICE.  APPLICABLE LAW MAY NOT ALLOW THE ABOVE EXCLUSION OF IMPLIED WARRANTIES, SO THE EXCLUSION MAY NOT APPLY TO YOU AND SHALL APPLY ONLY TO THE MAXIMUM EXTENT ALLOWED BY LAW.  
    2. WE DO NOT WARRANT THAT THE DONATION SUBSITE WILL MEET YOUR REQUIREMENTS, THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE DONATION SUBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
    3. WE DO NOT WARRANT OR MAKE ANY REPRESENTATIONS, AND AFFIRMATIVELY DISCLAIM ANY SUCH WARRANTIES AND REPRESENTATIONS, REGARDING THE USE OR THE RESULTS OF THE USE OF THE DONATION SUBSITE IN TERMS OF ITS CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.  WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, IMGE DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR THE ACCURACY OF ANY RECORD OR DOCUMENT GENERATED BY THE DONATION SUBSITE. 
    4. YOU UNDERSTAND AND AGREE THAT THE ALL DISCLAIMERS ARE MADE FOR OUR BENEFIT AND THE BENEFIT OF THE WEBSITE OPERATOR.
    5. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, IMGE, WEBSITE OPERATOR, IMGE’S AND WEBSITE OPERATOR’S AFFILIATES, EMPLOYEES, DIRECTORS, OFFICERS, MEMBERS, MANAGERS, AGENTS REPRESENTATIVES, SERVICE PROVIDERS, DIRECTORS, LICENSORS AND SUPPLIERS (IMGE, WEBSITE OPERATOR AND SUCH OTHER INDIVIDUALS AND ENTITIES INDIVIDUALLY AND COLLECTIVELY REFERRED TO AS “IMGE-RELATED PARTIES”) WILL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY OTHER PARTY UNDER OR IN CONNECTION WITH THIS TERMS OF USE OR FOR ANY ACTIVITY RELATED TO THE DONATION SUBSITE, WHETHER UNDER CONTRACT, TORT, OR ANY OTHER THEORY OF LIABILITY, FOR ANY AMOUNT IN EXCESS OF THE LESSER OF $150 OR THE ACTUAL, DIRECT DAMAGES INCURRED IN CONNECTION WITH THE ACTIVITY GIVING RISE TO THE CLAIM.  ADDITIONALLY, IMGE-RELATED PARTIES WILL NOT BE LIABLE FOR INDIRECT, CONSEQUENTIAL, INCIDENTAL, PUNITIVE, EXEMPLARY OR SPECIAL DAMAGES, OR LOST PROFITS.  TO THE EXTENT APPLICABLE LAW DOES NOT PERMIT THIS LIMITATION ON LIABILITY AND DAMAGES, IMGE’S LIABILITY AND EXPOSURE TO DAMAGES WILL BE LIMITED TO THE MAXIMUM EXTENT ALLOWED BY LAW.
    6. The appearance of external hyperlinks generated by third parties does not constitute endorsement by us or our affiliates of any content of the linked third party website, and we do not verify or take responsibility for the accuracy, currency, completeness, or quality of the content contained on these sites.  Therefore, neither IMGE nor its affiliates will be responsible for any errors or omissions or for the results obtained from the use of such information contained on these sites.  IN NO EVENT WILL WE BE LIABLE, DIRECTLY OR INDIRECTLY, TO ANYONE FOR ANY DAMAGE OR LOSS ARISING FROM OR RELATING TO ANY USE, CONTINUED USE OR RELIANCE ON ANY THIRD PARTY CONTENT DISPLAYED ON THE DONATION SUBSITE, ANY PRODUCTS, SERVICES OR OTHER MATERIALS RELATING TO ANY SUCH CONTENT, ANY LINKED THIRD-PARTY SITE, OR ANY LINK CONTAINED IN A LINKED SITE.
  12. Indemnification.  YOU agree to defend, indemnify, and hold us harmless from and against any claims arising from YOUR use of the Donation Subsite (except for claims resulting directly from our violation of law or tortious conduct), including but not limited to, any claim arising from any breach by YOU of any representation, warranty, or other term of the Terms of Use or violation of law. 
  13. Notice for California Residents.  Under California Civil Code Section 1789.3, we provide the following consumer rights notice: (a) we are located at 603 King Street, Alexandria VA 22314 (b) all charges made through the Donation Subsite are donations, and no fee is charged to the donor in connection with the donation; and (c) if you have a question or complaint regarding this Donation Subsite or IMGE’s services, please send an email to [email protected]  You may also contact us by writing to the address listed above, or by calling us at (703) 261-9121.  California residents may reach the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, California 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
  14. Arbitration.  In the event a dispute arises between you and IMGE, you and IMGE agree to first contact each otherby notice as provided in Section 20, and in such notice provide a written description of the problem, all relevant information and documents, and a proposed resolution.  You and IMGE will make good faith efforts to resolve the matter through discussion.  If, after 30 days, you and IMGE are unable to resolve the dispute, after such good faith negotiations, the dispute may be referred to binding arbitration at the election of either party, in accordance with this Section and the Terms of Use.  In agreeing to the Terms of Use, and by using  the Site, you agree that any claim, dispute, or controversy, whether based in law or equity, between you and IMGE, arising from or relating to (i) use of the Donation subsite, (ii) any transaction conducted by or through the donation subsite, or (iii) the application, interpretation, construction, enforceability, enforcement, formation or validity of the terms of use or privacy statement, including but not limited to a claim that all or part of this terms of use is void or voidable shall be resolved (if not settled informally) exclusively through binding arbitration by a single arbitrator WHOSE AWARD (DECISION) WILL BE BINDING AND FINAL, EXCEPT FOR A LIMITED RIGHT OF APPEAL as may be allowed UNDER THE FEDERAL ARBITRATION ACT.  ANY COURT WITH JURISDICTION OVER THE PARTIES MAY ENFORCE THE ARBITRATOR’S AWARD.  Agreeing to binding arbitration means that neither you nor IMGE will have the right to litigate a Claim subject to these Terms of Use in a court or have a jury trial on that Claim and you and IMGE hereby waive your right to a jury trial   . All arbitrations will be conducted before a single arbitrator and in accordance with the Commercial Arbitration Rules, including, where “you” are an individual and as applicable, the AAA's Consumer Rules then in effect, except to the extent that such Rules are inconsistent with these Terms of Use, in which case the Terms of Use shall control. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. The arbitration shall be held at a location determined by AAA in Alexandria Virginia, or at such other location as may be mutually agreed upon by you and IMGE.  Disputes shall be resolved by documents and without in-person or telephonic hearings, except that either party may require a telephonic hearing or, as may be acceptable to the arbitrator, require hearings in the form of a digital/video conference if such digital/video conferencing does not add materially to the cost of a telephonic hearing.  Without limiting further authority of the arbitrator as set forth in the rules, in the event the arbitrator determines that the claim at issue in the arbitration is frivolous or completely without merit, the party asserting the frivolous or non-meritorious claim shall be responsible for all costs associated with the arbitration. 
  15. Class Action Waiver.  additionally, you and imge each irrevocably agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.
  16. Injunctive Relief.  Notwithstanding anything to the contrary, IMGE will have the right to seek injunctive or other equitable relief in state or federal court located in Virginia to enforce these terms or prevent an infringement of a third party’s rights.  In the event equitable relief is sought, each party hereby irrevocably submits to the personal jurisdiction of such court.
  17. Limitations of Actions.  Without limiting the effect of any disclaimer contained herein, any cause of action you may have with respect to your use of the Site must be commenced within one (1) year after the claim or cause of action arises.
  18. Choice of Law.  This arbitration shall be governed by the Federal Arbitration Act, 9 U.S.C. § 1-16 (“FAA”), applicable federal law, the laws of the state of Virginia without regard to principles of conflict of laws, and the Terms of Use (including without limitation, limitations on liability and damages) Subject to the foregoing sentence, this Agreement shall be governed and interpreted in accordance with the substantive law of the Commonwealth of Virginia without regard to its conflict of law provisions. The Uniform Computer Information Transactions Act ("UCITA"), as enacted in the Commonwealth of Virginia or in any other Commonwealth or State of the United States, shall not apply to this Agreement to the maximum extent applicable law allows.
  19. Language.  The Terms of Use has been written in the English language, and you agree that this English language version will govern your use of the Donation Subsite, dispute proceedings, and the other matters described in the Terms of Use.
  20. Force Majeure.  We shall be excused from performance hereunder to the extent that performance is prevented, delayed or obstructed by causes beyond our reasonable control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labor conditions, earthquakes, or natural disasters.
  21. Assignment.  You may not assign any of your rights or obligations hereunder, whether by operation of law or otherwise, without our prior written consent.  Notwithstanding the foregoing, we may freely assign the Terms of Use, and the rights and obligations therein, without your consent, including but not limited to, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of our assets.  Subject to the foregoing, the Terms of Use shall bind and inure to the benefit of the parties, their respective successors and permitted assigns.
  22. Notice and Electronic Communications. Except as otherwise expressly specified in the Terms of Use, all notices, permissions and approvals hereunder shall be in writing and shall be deemed to have been given only upon: (a) personal delivery; (b) the fifth business day after mailing; (c) the first business day after sending by email; or (d) the second business day after being sent by internationally-recognized overnight courier.  Notices must be addressed as follows: if to us, to 603 King Street, Alexandria VA 22314 and for notices permitted to be sent via email, to [email protected] and, if to you, to the email address that you have provided us.  It is agreed that all agreements, notices, disclosures, and other communications provided in accordance with the Terms of Use satisfy any legal requirement that such communications be in writing. It is agreed that a printed version of this Terms of Use and/or any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

This Privacy Statement of IMGE LLC (“IMGE”, “we”, “us” or “our”) describes its policy for treatment of personal information (as defined below) on this donation form (the “Donation Subsite”), www.chrge.me. “You” in this Privacy Statement means you personally. IMGE has been retained by the operator of the website to operate the Donation Subsite.  For clarity, the Donation Subsite refers only to this form, and not to the website on which this form is located.  Also, this Privacy Statement applies only to the Donation Subsite, regardless of the platform on which it is used.  If you visit websites or other applications operated by IMGE, or other sites linked to the Donation Subsite, the privacy statement for the Donation Subsite will not control the practices for collecting and using personal information on those other sites.  This Privacy Statement does not apply to IMGE’s practices for collecting and using personal information offline or from sites or apps other than the Donation Subsite (even if that information is identical to the information gathered on the Donation Subsite).

What is “personal information” and what personal information do we collect?
By “personal information,” we mean information that is reasonably identifiable to you or to a particular device or that allows you or it to be so identified.
Personal Information We May Collect:  IMGE collects your email address for account creation and log-in purposes.    NOTE: We do not collect sensitive credit card information that may be processed in connection with your donations made in connection with the Donation Subsite.  We outsource processing of credit card transactions to Stripe.  Stripe processes personal information, including credit card information, you provide.  Please visit Stripe’s privacy policy for information regarding Stripe’s collection, use, and transfer of personal information, currently available at https://stripe.com/us/privacy. Should you elect to make a donation, we will have access to information you provide to Stripe, such as your name, address, email address, telephone number, employer, and occupation.  We may analyze this information for the purpose of providing consulting services to the campaign(s) and other organization(s) to which you donate.  The analyzed information, which may be shared with the campaign(s) and other organization(s) to which you donate, may include your personal information in a form that is identifiable to you.  The individual campaign(s) and other organization(s) to which you donate may also have access to the personal information you provide to Stripe though their individual Stripe accounts.  Please see the privacy policy for each campaign and other organization to which you donate for information regarding how that campaign and other organization’s collection, use, and transfer of personal information. 

We may also obtain information relating to analytics through the website operator.  You may choose to contact us and the information you disclose may constitute personal information.

How does IMGE use the information it collects?
We use personal information collected on the Donation Subsite for the following purposes:

  • to respond to inquiries from users
  • to provide information about the proper use or misuse of the Donation Subsite
  • to process technical or administrative issues or to communicate regarding those issues
  • to improve, expand, or otherwise adjust our services
  • to comply with federal law related to campaign donations.

Does the Donation Subsite use cookies?
IMGE may use “cookies” and similar technologies such as web beacons and pixel tags that may work in conjunction with cookies.   A cookie is a small text file that a website places on your computer’s hard drive that allows the website’s server to keep track of and facilitate certain activities on the site.  The Donation Subsite may use cookies to make using the Donation Subsite more efficient for donors.  We use information that we obtain by cookies, to the extent it is or becomes personal information, in accordance with the terms of this policy.  You may be able to set your browser to accept all cookies, block certain cookies, require your consent before a cookie is placed in your browser, or block all cookies.  Please consult the “Help” section of your browser for more information on cookies generally.  We do not use “Flash cookies.”  Please note that if you elect to block all cookies, we will not be able to remember your preferences, and you will have to manually input your log-in information to access the Donation Subsite. 

We use persistent cookies to facilitate your use of the Domain Subsite to make additional donations and donations across different websites.  When you elect to save your user credentials on the Donation Subsite, we will cause such a cookie to be placed in your browser to remember your preferences and facilitate later log-ins.  Please note that electing to save your user credentials on your device may allow others using your device to access your account and make donations from your device without your permission. 

How does IMGE treat “Do Not Track” requests from a user’s browser?

Users may have the option of enabling “Do Not Track” in their browsers, which sends a signal to websites that the user does not want to be tracked across multiple websites.  IMGE does not track users across multiple websites, regardless of whether users have enabled “Do Not Track.”

Under what circumstances does IMGE disclose or transfer personal information to others?
There are circumstances where we will transfer and/or disclose your personal information to third parties. Those circumstances, subject to the limits of applicable law, are as follows:

  • Subsidiaries and Affiliates:  IMGE may transfer personal information to its subsidiaries and corporate affiliates for purposes related to IMGE service offerings as such offerings may change and develop over time.
  • Organizations to which You Donate:  IMGE may share your personal information, including personal information collected by Stripe, with the campaign(s) and other organization(s) to which you donate.  Please see above.  Please review the privacy policies of the campaign or organization for information as to how each campaign or organization treats personal information.   
  • Donation Subsite Consultants and Service Providers:  IMGE may transfer personal information to third-party service providers, including those that may be hosting or housing data on behalf of IMGE or otherwise acting on its behalf as a data center (such as providers of hosting, cloud, technology outsourcing and support services).  Additionally, IMGE may disclose personal information to the extent that our service providers require access to our databases, or the information contained in our databases, to service IMGE and the Donation Subsite. 
  • Legal Compulsion and IMGE’s Protection:  IMGE reserves the right to release personal information in response to a subpoena or otherwise when we reasonably believe that the law requires us to do so or when we believe it is necessary to protect and/or enforce the rights, property interests, or safety of IMGE, our users, customers or others.
  • Reorganization or Sale of IMGE:  In the event that IMGE is merged with or becomes part of another organization, or in the event that IMGE is sold or it sells all or substantially all of its assets, or a brand or line of its business, the information you provide may be one of the transferred assets for use by the acquiring entity.
  • As Otherwise Allowed by Law:  We may transfer personal information to third parties where we are expressly authorized by applicable law to do so.

How do you keep my personal information secure?

Does the Donation Subsite link to any third-party sites?
The Donation Subsite may link to third-party sites.  When using third-party sites (for example, sites that take credit cards or otherwise process transactions), you should review the privacy policies of such third-party sites to understand how they collect and use personal information.

How long do you keep my information?
IMGE keeps personal information for as long as we deem it useful to use, and for as long as applicable law allows us to maintain it. 

How can I access and make changes to my personal information?
Donation Subsite users have the right to request that their information be modified or deleted from our files.  We will attempt to honor these requests, subject to applicable law and our judgment that the information is not important for us to maintain for our internal record-keeping purposes.  Requests to modify or delete personal information should be directed to [email protected]

How will I be notified of changes and updates to the Privacy Statement?
Changes and updates to this Privacy Statement will be posted on the Donation Subsite.  Updated Privacy Statements are effective upon posting to the Donation Subsite.
